NOTICE ON THE PROCESSING OF PERSONAL DATA

This notice has been prepared by Kraftbau Yapı Kimyasalları İnşaat Maden Enerji Jeotermal Sanayi ve Ticaret Anonim Şirketi, in its capacity as data controller, pursuant to Article 10 of the Turkish Personal Data Protection Law No. 6698 (Kişisel Verilerin Korunması Kanunu, “KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

YOUR PERSONAL DATA THAT WE PROCESS

Identity data; Name, surname, date of birth, membership number

Contact data; Mobile phone number, address details, e-mail address

Professional data; Project/application name, trade specialisation, project address, information on the projects in which the products are used, professional activity and application information

Membership and campaign transaction data; Craftsman Club membership records (monthly consumption quantity, information on brand preferences and brand habits, campaign preferences and participation history), campaign participation records, points submission information, points balance information, gift card entitlement and delivery information, details of the dealer from which the product was purchased, details of the dealer to which points were submitted, applications, requests and transaction records made under the campaign

Marketing data; Information on how you came to know KraftBau, campaign preferences and participation history, records relating to campaign and promotional activities

Social media data; Social media username, the platform on which posts are shared, information on posts and tagging carried out under the campaign, information on the KraftBau social media accounts followed

Visual and audio records; Photographs and images shared or submitted under the campaign, visual content submitted under the social media bonus, and, where explicit consent is given, photographs and visual records that may be used in social media, website, catalogue, advertising, promotional and corporate communication activities

METHOD OF COLLECTING YOUR PERSONAL DATA AND ITS LEGAL BASIS

Your personal data is collected by automatic or non-automatic means through KraftBau Craftsman Club membership forms, points submission forms, the website, mobile applications, membership transactions carried out via QR code, telephone, e-mail, social media platforms, physical documents, dealer channels, customer relations processes and other electronic or physical media.

Your personal data is processed on the following legal grounds set out in Article 5 of the KVKK;

  • The processing of personal data belonging to the parties to a contract being necessary, provided that it is directly related to the conclusion or performance of that contract,
  • Data processing being mandatory for the data controller to fulfil its legal obligations,
  • Data processing being mandatory for the establishment, exercise or protection of a right,
  • Data processing being mandatory for the legitimate interests of the data controller, provided that this does not harm the fundamental rights and freedoms of the data subject.

            In addition, the use of participants' photographs and images in social media, website, catalogue, advertising, promotional and corporate communication activities, and activities relating to the sending of commercial electronic messages, may be carried out on the basis of the explicit consent of the data subject.

PURPOSES OF PROCESSING YOUR PERSONAL DATA

  • Carrying out Craftsman Club membership processes,
  • Managing campaign participation processes,
  • Carrying out points submission, checking, verification and approval transactions,
  • Delivering the rewards and gift cards earned,
  • Enabling the use of the advantages and benefits offered under the campaign,
  • Confirming the accuracy of participant information, project information and campaign records,
  • Carrying out request, suggestion and complaint processes,
  • Carrying out activities aimed at customer satisfaction,
  • Developing products and services and carrying out market research activities,
  • Carrying out marketing, advertising, campaign, promotional and communication activities,
  • Offering greetings, information and advantages on birthdays and similar special occasions,
  • Evaluating and verifying social media bonus applications,
  • Carrying out social media, website, catalogue, advertising, promotional and corporate communication activities (where the explicit consent of the data subject has been given),
  • Carrying out information security processes,
  • Fulfilling legal obligations,
  • Fulfilling the burden of proof in potential disputes and following up and conducting legal affairs,
  • Responding to requests from authorised institutions and organisations,
  • Carrying out storage and archiving activities.

 SHARING YOUR PERSONAL DATA WITH THIRD PARTIES

            Within the scope of Article 8 of the KVKK and limited to the data processing purposes, your personal data may be transferred to;

  • Authorised KraftBau dealers, for the purpose of carrying out campaign processes and delivering rewards,
  • Suppliers from which information technology, software, data hosting, maintenance and support services are obtained,
  • Consultants from which legal, financial and audit services are obtained,
  • Authorised public institutions and organisations, upon request,
  • Lawyers, enforcement offices, courts and other competent authorities, for the purpose of resolving legal disputes,
  • Business partners and suppliers from which services are obtained for the purpose of delivering rewards and carrying out customer satisfaction, communication and campaign processes.

            Your personal data may be transferred abroad, within the framework of the conditions set out in Article 9 of the Personal Data Protection Law No. 6698, via the social media platforms, e-mail and cloud-based information technology infrastructures used in the course of carrying out campaign processes, communication activities and social media bonus applications.

YOUR RIGHTS

Pursuant to Article 11 of the Personal Data Protection Law No. 6698 (“KVKK”), by applying to Kraftbau Yapı Kimyasalları İnşaat Maden Enerji Jeotermal Sanayi Ve Ticaret Anonim Şirketi, subject to verifying your identity, you have the right, in relation to your personal data, to;

  • Learn whether your personal data is being processed,
  • Request information if your personal data has been processed,
  • Learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
  • Learn whether your personal data is transferred domestically or abroad and, if so, to whom it has been transferred,
  • Request the rectification of your personal data if it has been processed incompletely or inaccurately,
  • Request that the third parties to whom your personal data has been or may have been transferred be notified of the rectification carried out,
  • Request the erasure, destruction or anonymisation of your personal data within the framework of the conditions set out in Article 7 of the KVKK,
  • Request that the third parties to whom your personal data has been transferred be notified of the requested erasure, destruction or anonymisation,
  • Object to a result arising against you from the analysis of your personal data exclusively by automated systems,
  • Request compensation for damage if you suffer damage due to the unlawful processing of your personal data.

You may submit your requests regarding the processing of your personal data in writing, in accordance with the application procedures set out in this Notice, and via the e-mail address registered in our systems.

Your applications will be concluded free of charge within thirty (30) days at the latest, depending on the nature of the request. However, if the application incurs an additional cost, the fee set out in the tariff determined by the Personal Data Protection Board may be charged. Our Company may accept the request and process it, or may reject the request in writing, stating its reasons.

If an application made by following the procedure described above is rejected, the response given is found insufficient, or no response is given to the application within the prescribed period, there is a right to lodge a complaint with the Personal Data Protection Board (the “Board”) within thirty days of being notified of the response and, in any event, within sixty days of the date of application. However, the complaint route cannot be used before the application route has been exhausted.

The Board carries out the necessary examination on matters within its remit, either upon complaint or ex officio where it learns of an alleged breach. Upon a complaint, the Board examines the request and responds to the parties concerned. If no response is given within sixty days of the date of the complaint, the request is deemed rejected. If, as a result of an examination carried out upon complaint or ex officio, the existence of a breach is established, the Board decides that the unlawful acts it has identified be remedied by the data controller and notifies the parties concerned. This decision is implemented without delay and within thirty days at the latest of its notification. Where damage that is difficult or impossible to remedy may arise and there is a clear breach of the law, the Board may decide to suspend the processing of data or its transfer abroad.

You may submit your requests regarding the rights listed in Article 11 of the Personal Data Protection Law No. 6698;

by completing the Personal Data Subject Application Form available at https://kraftbau.com.tr/iletisim/ and delivering it to the address Zübeyde Hanım Mah. Sarma Cad. No: 4 İç Kapı No: 5 Altındağ / Ankara as a wet-signed petition, in person, via a notary public or by registered mail with return receipt, by handing in your wet-signed petition in person.

For an application to be made by a person other than the data subject, a notarised special power of attorney issued in the name of the person making the application must be attached to the application.
